Terms of Service

This is a founder-drafted policy describing how DealSafe actually works, written to be read and understood before launch. It is not a substitute for review by a qualified solicitor before DealSafe accepts real users.

1. What DealSafe is

DealSafe is operated by XLR8 (“we”, “us”). It helps creators track deals, payments and manager/agency commissions, and gives educational flags about contract terms worth asking questions about. DealSafe is not a law firm, accountancy practice, talent agency, or financial adviser, and using it does not create a legal, accounting, or agency relationship between you and us.

2. Not legal or financial advice

Contract Check and SplitCheck give educational information only. They highlight clauses or numbers that may be worth asking about — they never state that a contract is valid, invalid, enforceable, or safe to sign, and they never tell you what to do. For anything with real money or legal risk attached, use our optional Expert Review or consult your own qualified solicitor or accountant. You are solely responsible for decisions you make about your deals.

3. Your account

You must be at least 18 to create an account. You’re responsible for keeping your password confidential and for activity that happens under your account. Tell us immediately if you suspect unauthorised access.

4. Workspaces and roles

A workspace belongs to you (a creator) or an agency, and can have members with different roles (owner, admin, manager, accountant, member) with different permissions. If you invite someone into your workspace, you’re responsible for what you choose to share with them.

5. Contract Check — how your document is handled

When you upload or paste a contract for analysis: it is processed in memory, and by default the source text is deleted from our systems within 5 minutes of analysis (an in-process timer, a background cleanup job, and a manual “delete now” control all enforce this). Only the flags you’re shown, and any deal details you separately choose to save to your ledger, are kept. The one exception is your own explicit choice: after a check, you may opt in to keep the original file for a specific deal in your Deal History (Section 5a) — that never happens automatically. See our Privacy Policy for how AI processing fits into this.

5a. Deal History — keeping a contract on purpose

If you choose “Keep the original contract in my Deal History” for a deal, we store that file encrypted (application-level AES-256-GCM, in addition to storage-level encryption) and keep it until you remove it or delete your account. You can remove a kept contract from a deal at any time from that deal’s page, and doing so deletes it from our systems. This is always a per-deal, opt-in choice — we never keep a contract you haven’t explicitly asked us to keep.

6. Subscriptions and billing

Paid plans are billed in advance, monthly or annually, via Stripe. You can cancel or change plans at any time from Settings; cancelling stops future billing but doesn’t refund the current period unless required by law. Free-tier usage limits are described on our pricing page and may change with notice. We never take a percentage of your deal earnings under any plan.

7. Acceptable use

Don’t use DealSafe to upload content you don’t have the right to share, to attempt to extract other users’ data, to abuse the contract-analysis feature to generate content unrelated to your own deals, or to circumvent plan limits or rate limits. We may suspend accounts that do.

8. Founding Creator access

Former XLR8 creators may be individually offered Lifetime Pro access via a personal invite link. This access has no obligation attached — not to endorse, promote, or remain in contact — and excludes future high-cost human services or enterprise features unless we say otherwise.

9. Disclaimers and liability

DealSafe is provided “as is”. We work hard to keep flags accurate and rules explainable, but automated and AI-assisted analysis can be wrong or incomplete, and we don’t guarantee it will catch every issue in a contract. To the extent permitted by law, our liability for any claim relating to DealSafe is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability that can’t legally be limited, including for death or personal injury caused by negligence, or fraud.

10. Termination

You can close your account at any time from Settings. We may suspend or terminate accounts that breach these terms, with notice where reasonably possible.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
